2016 Property Dispute - OntkeanSummary - After receiving a demand letter and having their land surveyed, Homeowners at 3011 NW Lacamas Drive filed a lawsuit against the Lacamas Shores Homeowners Association in Clark County Superior Court on May 4, 2016 (Case No. 16-2-5262-8). The first Complaint alleged a claim for adverse possession and was amended to drop that claim and seek a prescriptive easement to use a portion of the common area for a garden and patio area. The Association has filed a counterclaim asserting a claim for Declaratory Relief affirming that the Association is the owner of the property.
More details and Settlement Agreement - Link Note: There has been a question about the permissions granted in the settlement and the legalities involved. Rest assured, the HOA's legal team (three attorneys from two separate firms) prepared the settlement documents protecting the HOA's interests in accordance with all legal requirements. Those legally recorded and public documents did not convey any HOA property. Based on advice from counsel and other fiduciary considerations, the Board unanimously passed a motion to approve the settlement documents after coming out of Executive Session and during the January 16, 2017 regular Board Meeting, in accordance with the CC&Rs, the best interests of the HOA, and the law. |
2017 Domain Dispute - Arnold'sSummary - In 2016, the rightful ownership of the domains; lacamasshores.org, lacamas-shores.com, and lacamasshoreshoa became contested. The Board felt the domains belonged to the Association and C Arnold felt the domains belonged to her. The LS HOA filed for an arbitration proceeding with the WIPO ("World Intellectual Property Organization") to settle the intellectual property issue for quick resolution.
